4. Our Products
We aim to ensure that all product descriptions, photographs, specifications, dimensions and other information displayed on our website are accurate and up to date.
However, please note that:
- Colours may appear differently depending on your device and screen settings.
- Product photographs may contain lifestyle settings or accessories that are not included with the product.
- Product dimensions and specifications should be checked before ordering.
- Manufacturers may make reasonable changes to product specifications where appropriate.
- Some products may be supplied directly by one of our approved suppliers or fulfilment partners.
Where a product has specific requirements regarding assembly, access, installation, foundations or delivery, these will be communicated on the relevant product page or before purchase where reasonably possible.
Nothing in these Terms limits your legal rights if a product does not match its description, is not of satisfactory quality or is not fit for purpose.
Under the Consumer Rights Act 2015, goods supplied to consumers must meet statutory standards including being as described, of satisfactory quality and fit for purpose.
5. Product Availability
We aim to ensure products shown as available on our website can be supplied.
However, availability may change and there may occasionally be circumstances where an item becomes unavailable after you place an order.
If we are unable to fulfil an order, we will contact you as soon as reasonably possible and, where appropriate, provide a full refund of any amount you have paid for the unavailable product.
6. Placing an Order
When you place an order through our website, you are making an offer to purchase the products in your order.
After placing your order, you will normally receive an order acknowledgement confirming that we have received your order.
This acknowledgement does not necessarily mean that your order has been accepted.
Your order will be accepted when we send you confirmation that the order has been accepted and is being processed for fulfilment.
We reserve the right to decline or cancel an order where there is a genuine and reasonable reason to do so, including:
- A product being unavailable.
- A pricing or product description error.
- Suspected fraudulent activity.
- A technical error affecting the order.
- An inability to deliver to the address provided.
- A supplier being unable to fulfil the order.
If we cancel an order after you have paid, we will refund the amount you paid for the cancelled order.
7. Your Information
When placing an order, you must provide accurate and complete information.
This includes information such as:
- Your name.
- Delivery address.
- Billing information.
- Email address.
- Telephone number where requested.
You are responsible for checking that your information is correct before submitting your order.
If incorrect information results in a failed or additional delivery, we may need to work with you and the delivery provider to arrange a further delivery.
8. Prices
All prices displayed on our website are in Pounds Sterling (£).
Unless otherwise stated, prices displayed to consumers include applicable UK VAT.
We aim to ensure that all prices displayed on our website are accurate.
We reserve the right to correct genuine pricing errors.
If a genuine pricing error affects an order, we will contact you before fulfilling the order and give you the opportunity to proceed at the correct price or cancel the order for a full refund.
We will not deliberately advertise a misleading price.
UK consumer law requires businesses to provide clear and transparent pricing and avoid practices such as hidden mandatory charges or misleading headline prices.
9. Promotions and Discounts
From time to time, we may offer promotional codes, discounts or special offers.
Promotional offers may be subject to additional terms, including:
- Start and expiry dates.
- Product exclusions.
- Minimum order values.
- One-use restrictions.
- Customer eligibility requirements.
Where additional terms apply, these will be made clear when the promotion is offered.
Promotions cannot normally be combined unless expressly stated otherwise.
10. Payment
Payment must be made using one of the payment methods available at checkout.
Payments are processed through third-party payment providers and may be subject to their own terms and conditions.
We do not normally have access to or store your complete payment card details.
Your payment must be successfully authorised before your order can be processed.
11. Delivery
We currently provide delivery to mainland UK only, subject to the delivery restrictions set out in our Shipping Policy.
We currently offer free standard delivery to eligible mainland UK addresses unless otherwise stated on the relevant product page.
Delivery times are estimates and may vary depending on the product, supplier and delivery method.
Some larger products may require specialist or pallet delivery.
Where an order is fulfilled directly by one of our suppliers, the supplier or its appointed delivery partner may contact you to arrange delivery.
Further information is available in our Shipping Policy.
12. Delivery Delays
We will make reasonable efforts to ensure your order arrives within the estimated delivery period.
However, delivery may occasionally be affected by circumstances outside our reasonable control, including:
- Severe weather.
- Courier disruption.
- Supplier delays.
- Unexpected demand.
- Transport disruption.
- Other events beyond our reasonable control.
If there is a significant delay, we will provide an appropriate update and work with you to resolve the situation.
Nothing in this section limits your statutory rights where goods are not delivered within the period required by law.
13. Risk and Delivery
Where you are purchasing as a consumer, responsibility for the goods remains with Love Thy Garden until the goods come into your physical possession, or the possession of a person you have identified to receive them, unless you have independently arranged a carrier not offered by us.
We will not attempt to transfer responsibility for loss or damage to you simply because the goods have been handed to our courier or supplier.
14. Inspecting Your Delivery
We recommend checking your order as soon as reasonably possible after delivery.
If an item appears damaged, please contact us promptly and provide photographs where possible.
You should not refuse a delivery solely because the packaging shows minor external damage unless the delivery provider's procedures require this.
A failure to report damage immediately does not remove your statutory rights.
15. Returns and Your Right to Cancel
If you purchase goods from Love Thy Garden as a consumer online, you generally have a statutory right to cancel your order within 14 days of receiving the goods, subject to the legal exceptions that apply to certain products.
After telling us that you wish to cancel, you normally have a further 14 days to return the goods.
Our full procedure is explained in our Returns & Refund Policy.
Nothing in our Returns & Refund Policy or these Terms limits your statutory rights.
16. Faulty, Damaged or Incorrect Goods
If goods are:
- Faulty.
- Damaged.
- Not as described.
- Not fit for their intended purpose.
- Incorrectly supplied.
please contact us as soon as reasonably possible.
Depending on the circumstances and your legal rights, you may be entitled to:
- A repair.
- A replacement.
- A price reduction.
- A refund.
Your legal rights depend on the circumstances, including when the problem occurred and the nature of the fault.
We will deal with complaints and remedies in accordance with applicable UK consumer law.
The Consumer Rights Act 2015 provides consumers with statutory protections concerning the quality, description and fitness of goods.
17. Made-to-Order and Bespoke Products
Some products may be made specifically to your requirements or personalised according to your instructions.
Where a product is genuinely made to your specifications or personalised, the statutory cancellation rights that normally apply to distance sales may not apply.
Any applicable exclusion will be clearly communicated before you place your order.
This does not affect your statutory rights if the product is faulty, not as described or otherwise does not comply with your legal rights.
18. Product Assembly and Installation
Where products require assembly or installation, you are responsible for ensuring that:
- The installation location is suitable.
- Adequate access is available.
- Appropriate foundations or surfaces are provided where required.
- Assembly instructions are followed.
- Any necessary permissions are obtained.
Where Love Thy Garden or a third-party installer provides installation services, those services may be subject to separate terms.
Unless expressly included in your order, installation is not included in the purchase price of a product.
19. Intellectual Property
All intellectual property rights relating to the Love Thy Garden website and our own content belong to Love Thy Garden Ltd or our licensors.
This includes, where applicable:

Some product information, photographs, specifications and other materials may be provided to Love Thy Garden by manufacturers, suppliers or fulfilment partners.
We use reasonable care when publishing this information and seek to ensure that it is accurate.
Where we become aware of an error, we will take reasonable steps to correct it.
Nothing in this section affects your statutory rights concerning products purchased from us.
21. Third-Party Websites and Services
Our website may contain links to third-party websites or services, including manufacturers, suppliers, payment providers and social media platforms.
We are not responsible for the content, security or privacy practices of websites that we do not control.
You should review the terms and privacy policies of third-party websites before using them.
22. Shopify
Our website is powered by Shopify.
However, purchases made through our website are contracts between you and Love Thy Garden Ltd.
Shopify provides the technology that allows us to operate our ecommerce website but is not the seller of the products purchased from Love Thy Garden.
Nothing in these Terms creates a contract between you and Shopify in relation to your purchase from Love Thy Garden.
23. Reviews and Customer Content
If you submit a product review, photograph, testimonial or other content to us, you confirm that:
- The content is truthful and based on your genuine experience.
- You have the right to submit the content.
- The content does not infringe another person's intellectual property or privacy rights.
- The content is not unlawful, threatening, abusive, defamatory or misleading.
Where you provide content for publication, you grant Love Thy Garden a non-exclusive, royalty-free licence to use, reproduce, display and publish that content for the purposes of operating and promoting Love Thy Garden.
We may remove content where we reasonably believe it breaches these Terms or applicable law.
We will not falsely present reviews or testimonials as genuine customer experiences.
UK consumer protection law contains specific requirements concerning fake or misleading reviews and other unfair commercial practices.

We make reasonable efforts to ensure that information on our website is accurate.
Occasionally, our website may contain genuine errors relating to:
- Product descriptions.
- Prices.
- Availability.
- Delivery information.
- Specifications.
- Promotional information.
Where we identify an error, we may correct it.
If an error materially affects an order you have placed, we will contact you and provide an appropriate solution.
We will not use this provision to remove or reduce your statutory consumer rights.
25. Our Liability to Consumers
Nothing in these Terms excludes or limits our liability where doing so would be unlawful.
In particular, nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence.
- Fraud or fraudulent misrepresentation.
- Breach of your statutory consumer rights.
- Faulty products where liability cannot legally be excluded.
- Any other liability that cannot legally be excluded or limited.
We are responsible for supplying goods that meet the legal standards applicable to consumer purchases.
Any limitation of liability must be interpreted subject to your statutory rights.
UK consumer law does not permit businesses to contract out of certain responsibilities, including responsibility for faulty or misdescribed goods.
26. Events Outside Our Reasonable Control
We will not be responsible for delays or failures caused by circumstances genuinely outside our reasonable control.
These may include:
- Extreme weather.
- Natural disasters.
- Fire.
- Flood.
- Serious transport disruption.
- Industrial action.
- Government restrictions.
- Major infrastructure failures.
- Significant supplier disruption.
- Other events that could not reasonably have been prevented.
Where such circumstances occur, we will take reasonable steps to minimise the impact and keep you informed.
This section does not remove any rights you have to cancel an order or receive a refund where required by law.
27. Suspension or Termination of Accounts
If you create an account with Love Thy Garden, you must keep your login information secure.
We may suspend or close an account where reasonably necessary, including where we reasonably suspect:
- Fraudulent activity.
- Unauthorised access.
- Serious misuse of our website.
- A breach of these Terms.
Closing or suspending an account does not affect any rights or obligations that have already arisen.
28. Privacy
Your personal information is handled in accordance with our Privacy Policy.
Our Privacy Policy explains:
- What information we collect.
- Why we collect it.
- How we use it.
- Who we share it with.
- Your data protection rights.

- Our business.
- Our products or services.
- Legal or regulatory requirements.
- Website functionality.
- Our policies and procedures.
The latest version will always be available on our website.
The "Last updated" date at the top of these Terms will show when they were last amended.
Changes will not affect rights you have already acquired under an order that has been accepted.
30. Governing Law
These Terms and any contract between you and Love Thy Garden Ltd are governed by the law of England and Wales, except where mandatory consumer protection legislation in another part of the United Kingdom applies.
If you are a consumer, you will retain any mandatory rights you have under the law of the part of the UK in which you live.
